Important: These Terms govern use of this website and provide baseline terms for services offered by Jacquelyn Mikus LLC, doing business as Jacquelyn Mikus ("Jacquelyn Mikus," "I," "me," or "my"), including work presented under the creative signature the creative current within the work. Custom experiences, retreats, facilitation, longer-term 1:1 containers, collaborations and event-support engagements may also require a separate proposal, service agreement, participant waiver, informed-consent form or media release. If a signed agreement conflicts with these Terms, the signed agreement controls for that booking.
1. Agreement to these Terms
By accessing this website, purchasing a service, booking a session, submitting payment, or participating in an offering, you acknowledge that you have read and agree to these Terms and any booking-specific policies or agreements that apply to your Service.
2. Who may book
You must be at least 18 years old and legally able to enter a contract to book Services. A parent or legal guardian must arrange and consent to participation by a minor.
3. Inquiries are not bookings
Submitting an inquiry does not create a client relationship, reserve a date, or obligate either of us to proceed. A booking is confirmed only when the applicable agreement is accepted and any required deposit or payment is received.
4. Payment, deposits & refunds
All purchases are final and non-refundable, except where otherwise required by applicable law or expressly stated in a signed booking agreement. By purchasing a session, package, program, experience or other Service, you acknowledge that you are making a commitment to the Service purchased.
For custom, in-person, group, retreat, event or curated work, a deposit or planning/curation fee may be required to reserve time and begin preparation. Unless expressly stated otherwise in writing, such deposits and planning/curation fees are non-refundable. Third-party expenses, tickets, vendor deposits, venue fees, travel costs, supplies and other amounts already paid or committed on your behalf are also non-refundable to the extent they cannot reasonably be recovered.
Where a payment plan applies, you remain responsible for the agreed payment schedule unless a signed agreement states otherwise.
5. 1:1 session scheduling, rescheduling & cancellations
If you need to reschedule a scheduled 1:1 session, please provide at least 24 hours' notice before your appointment time.
Requests made with less than 24 hours' notice may result in the session being forfeited and are not guaranteed to be rescheduled. Exceptions may be made for illness, emergencies or other extenuating circumstances at Jacquelyn Mikus's discretion.
If you do not attend your scheduled session and have not provided prior notice, the session will be considered completed and forfeited. Jacquelyn Mikus is not obligated to provide a replacement session or refund for a missed appointment.
If I need to reschedule a session, I will offer a mutually agreeable alternative time.
6. Custom and in-person cancellations, changes & rescheduling
Custom experiences, in-person work, events, retreats, collaborations and longer engagements may have booking-specific cancellation, rescheduling and change terms because dates, preparation time, vendors and third-party commitments may be reserved in advance. Those terms will be provided in writing and will control for that booking.
Changing the date, participant count, scope, location or requested services may change the investment and may require a revised agreement. Costs already paid or committed to third parties may remain non-refundable.
7. Nature of Services
Services provided by Jacquelyn Mikus may include facilitation, mentoring, guidance, education, reflection, personal-development support, creative and vision work, curated experiences, experiential work, gatherings, collaborations and related services intended to support clarity, self-trust, meaningful participation, personal growth, decision-making, creation and the client's own process of change.
Services do not constitute medical care, psychotherapy, mental-health treatment, diagnosis, legal advice, financial advice or other licensed professional services and should not be used as a substitute for appropriate professional care.
You remain responsible for seeking qualified professional support when needed and for your own decisions, actions, wellbeing and results.
8. No guarantee of results
While I am committed to providing Services with care, discernment and integrity, individual experiences and outcomes vary. No particular personal, emotional, spiritual, relationship, career, health, financial, business or creative result is promised or guaranteed.
Your experience and results depend on many factors, including your own choices, participation, circumstances, actions, implementation and factors outside either party's control.
9. Facilitation, personal responsibility & boundaries
Facilitation may invite reflection, emotion, perspective, intention, creative exploration or personal choice. You retain full authority and responsibility for your decisions, boundaries, participation, wellbeing and actions. You may decline a prompt, practice, activity or suggestion at any time.
10. In-person activities, outdoor environments & assumption of risk
In-person Services may include outdoor activity in Sedona or elsewhere, walking or hiking on uneven or rocky terrain, heat, sun, altitude, weather exposure, wildlife, travel, movement practices, meditation, breathwork, ceremony, food and beverages, transportation arranged by third parties, and reflective or emotionally evocative experiences. These activities may involve foreseeable and unforeseeable risks, including illness, injury, emotional discomfort, property loss or damage and, in rare circumstances, serious injury or death.
By choosing to participate, you knowingly and voluntarily assume the ordinary and inherent risks associated with the activities, locations and conditions involved. You are responsible for deciding whether an activity is appropriate for you, following safety instructions, using reasonable judgment, and stopping or declining any activity that does not feel appropriate.
To the fullest extent permitted by law, you release and agree to hold harmless Jacquelyn Mikus LLC, Jacquelyn Mikus, and their contractors and agents from claims arising from inherent risks of voluntary participation, your own actions or omissions, or conditions outside their reasonable control. Nothing in these Terms waives liability that cannot lawfully be waived.
11. Health, accessibility, allergies & participant disclosures
You are responsible for disclosing allergies, accessibility needs, mobility limitations, relevant health considerations or other information reasonably necessary for safe participation. You should consult an appropriate healthcare professional before participating in an activity if you have questions about whether it is suitable for you.
I may modify or decline an activity when I reasonably believe participation would present a safety concern. A separate informed-consent or liability-waiver form may be required for particular activities.
12. Third-party providers, venues & practitioners
An experience may involve independent venues, guides, practitioners, caterers, transportation providers, lodging providers, photographers or other vendors. They are separate businesses responsible for their own services, personnel, safety practices, availability, insurance and terms. Their own contracts, waivers and policies may apply.
Unless expressly agreed in writing, Jacquelyn Mikus does not control and is not responsible for a third party's acts, omissions, delays, cancellations, representations, products or services.
13. Travel, transportation & personal property
Unless expressly included in writing, you are responsible for your own transportation, lodging, travel arrangements, personal belongings and travel-related decisions. You are responsible for complying with the rules of venues, public lands, transportation providers and other locations used during a Service.
Jacquelyn Mikus is not responsible for lost, stolen or damaged personal property, or for travel delays, missed transportation, lodging issues or other travel disruptions outside reasonable control.
14. Weather, public-land conditions & force majeure
Weather, wildfire, smoke, public-land closures, road conditions, illness, travel disruption, natural disaster, government action, emergency conditions, vendor unavailability and other circumstances outside reasonable control may require an itinerary, provider, activity, location, date or Service to change.
When that happens, I will use reasonable efforts to offer an appropriate alternative, subject to safety, availability and non-recoverable costs. A change caused by circumstances outside reasonable control does not automatically create a right to a refund of non-recoverable or already-earned amounts.
15. Events, retreats & collaborations
When I contribute to an event, retreat or gathering created by another host, my responsibilities are limited to the scope agreed in writing. Unless expressly included in that agreement, the host remains responsible for its program, participant agreements and waivers, insurance, permits, venue and vendor contracts, regulatory compliance, emergency planning and overall duty of care to attendees.
16. Photography, video & media use
Photography and video may be captured during in-person experiences, events, retreats, gatherings and collaborations. Unless you notify me in writing before the applicable experience that you do not consent to identifiable photography or video, you grant Jacquelyn Mikus LLC a non-exclusive, worldwide, royalty-free permission to photograph and record your participation and to use your image, likeness and appearance in website, portfolio, social-media, editorial, promotional and marketing materials related to the business.
I will not intentionally use highly sensitive personal disclosures as promotional content merely because they occurred during an experience. Identifiable media from a private 1:1 session, and use of your voice, written testimonial or personal story in a way that identifies you, will require separate consent unless otherwise agreed in writing.
You may opt out of identifiable photography or video by emailing hello@jacquelynmikus.com before the experience. For minors, permission must come from a parent or legal guardian.
17. Session recording & transcription
Online or private sessions may be recorded and/or transcribed for purposes such as note-taking, session review, recordkeeping, educational development or content development. When a session is recorded, you will be notified through the meeting platform and/or at the beginning of the session.
I may use generalized insights or excerpts from a session in educational or creative content only when you are not visually or personally identifiable and your voice, name, likeness, identifying information and confidential details are not included. Public-facing use of identifiable participation requires separate consent.
18. Conduct, safety & right to refuse or discontinue Services
I reserve the right to decline, pause, modify or discontinue Services or a participant's involvement when reasonably appropriate, including for safety concerns, unlawful conduct, harassment, abuse, material disruption, non-payment, misuse of Services, boundary concerns or another serious breach of the applicable agreement.
Any payment obligations or refunds, if applicable, will be handled consistently with these Terms, the booking-specific agreement and applicable law.
19. Limitation of liability
To the fullest extent permitted by applicable law, Jacquelyn Mikus LLC, Jacquelyn Mikus, and their owners, contractors, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from the website or Services, participation in an experience, reliance on information provided, third-party services, or decisions or actions you take following the Services.
To the fullest extent permitted by law, aggregate liability for a claim relating to a specific paid Service will not exceed the amount actually paid to Jacquelyn Mikus LLC for that specific Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
20. Separate waivers, releases & booking agreements
These website Terms are baseline terms and are not intended to replace any separate participant waiver, informed-consent form, media release, venue waiver, practitioner agreement, proposal or service agreement appropriate for a particular activity or engagement. You may be required to sign additional documents before participating.
21. Intellectual property
Unless otherwise stated, the text, branding, photographs, graphics, teachings, written materials, resources and other original materials on this website or provided through Services are owned by or licensed to Jacquelyn Mikus LLC and are provided for your personal, non-commercial use. They may not be copied, reproduced, distributed, sold, adapted or commercially used without prior written permission.
22. Values, philosophy & educational statements
Statements made by Jacquelyn Mikus, the creative current within the work or Jacquelyn Mikus LLC regarding values, philosophy, spirituality, transformation, sovereignty, integrity, care, devotion, possibility or similar concepts are intended to describe the orientation of the work and, where applicable, provide educational or informational content. They do not create separate contractual guarantees, warranties, fiduciary duties or promises of a particular experience or outcome beyond those expressly stated in a signed agreement.
23. Website availability & external links
I do not promise that this website will always be available, error-free or free of harmful code. Links or embedded tools from third parties are provided for convenience and do not make me responsible for those sites, services or their practices.
24. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Venue for disputes relating to these Terms or Services will lie in a court of competent jurisdiction in Arizona, unless a signed booking agreement provides otherwise or applicable law requires a different forum.
25. Severability; no waiver; changes
If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision once is not a waiver of the right to enforce it later. I may update these Terms prospectively by posting a revised effective date.
